A responsabilidade civil dos árbitros perante as partes no ordenamento jurídico moçambicano

Abstract

This paper deals with the civil liability of arbitrators before the parties to the mozambican legal system, addressing the solutions assumed by the mozambican legislator on the matter. The role of the arbitrator and the arbitration, their duties and their status are discussed, as it will be on the basis of the same that the main answers to the problem in question will be found. When doing the respective study, it is demonstrated that the arbitrator exercises a jurisdictional function, functionally equating to state judges, resulting in the need to understand whether the regime applicable to judges, for the most part, also applies to arbitrators. By virtue of this, it is understood the relevance that alternative means of dispute resolution, specifically arbitration, have in the process of social pacification and the realization of justice
